The crime rates have been an alarming signal not only for India but also for the world. The trend of involving children in the crime at either side, whether as an offender or as a victim has been capturing the neck of the world’s crime situation.

Examining all elements of juvenile delinquency in major nations, as well as the efforts, are taken by these countries to combat juvenile offenders, and comparing their legislation to those in India.

Various countries follow the two-step process that means the date on which the crime was committed is the age of the child and the mens rea or whether the child is capable of having that particular knowledge of committing the crime. 

In one of the most famous cases of Bihar, that marked the knowledge and capacity of the individual or the child, i.e. the immaturity of the act done by the child at that point of time.

But the point here is, if the shreds of evidence aren’t proved beyond a reasonable doubt then it is assumed that the child has that particular knowledge or he had the intended intention to commit that particular crime.
