It is indeed concerning when a government official, especially the Union Law Minister, makes statements that threaten the fundamental rights of citizens, including retired judges, to free speech and expression. Labeling individuals who question state policies as “anti-India” is a flawed and dangerous notion that can lead to the suppression of dissent and critical thinking, which are essential for a healthy democracy.

Moreover, the use of intimidatory language and threats against retired judges is unacceptable and goes against the principles of the rule of law and the independence of the judiciary. It is crucial to respect the judiciary’s role in upholding the Constitution and safeguarding citizens’ rights and freedoms.

The Union Law Minister’s statements are defamatory and can have a chilling effect on citizens’ willingness to speak out against government policies that they perceive to be unconstitutional. It is vital to ensure that such statements are not made lightly and that government officials uphold the values of the Constitution and the democratic framework of the country.

Yes, as per the Indian Constitution, all citizens of India, including retired judges, have the fundamental right to freedom of speech and expression guaranteed under Article 19(1)(a). This right is essential for the functioning of democracy as it allows individuals to express their opinions, ideas, and dissenting views on various issues without fear of retribution.

Moreover, in a democratic society, it is the duty of citizens, including retired judges, to speak up against any actions that violate the constitutional framework of the country. This duty is enshrined in the Preamble of the Indian Constitution, which calls for securing justice, liberty, equality, and fraternity for all citizens.

The remark made by the Law Minister is truly chilling and has no place in a democratic society. The Prime Minister must distance himself from such remarks and take appropriate action against those who seek to undermine the very fabric of our constitution.
