In a significant move earlier this year, the Chief Minister of Rajasthan, a state in India, announced the establishment of the country’s first welfare fund specifically designed for gig workers. Known as the Rajasthan Platform-Based Gig Workers Social Security and Welfare Fund, this initiative represents a groundbreaking regulatory step towards addressing the vulnerabilities faced by gig and platform workers. It is particularly noteworthy as it precedes the implementation of the Code on Social Security, which was passed in 2020 but is yet to be fully implemented by many state governments across India.

The Code on Social Security was introduced in response to the COVID-19 pandemic when platform workers emerged as crucial contributors to the functioning of metropolitan logistics. They played a pivotal role in serving customers and collaborating with state governments to implement food relief schemes. However, the classification of these workers as “independent contractors” has created a complex situation. Although gig and platform workers are expected to abide by rules that resemble an employment relationship, their status as independent contractors often denies them access to benefits and protections typically enjoyed by regular employees.

This regulatory gap has raised concerns about the pace at which gig and platform workers can obtain essential benefits. With the delay in the implementation of the Code on Social Security by several state governments, the plight of these workers continues, leaving them vulnerable and without adequate support. It is against this backdrop that Rajasthan’s proactive approach stands out, positioning the state as a frontrunner in addressing the challenges faced by gig workers.

The Rajasthan Platform-Based Gig Workers Social Security and Welfare Fund aims to provide a safety net for gig workers by offering social security benefits and welfare measures. While the specific details of the fund are yet to be fully disclosed, it signifies a significant step towards recognizing the unique needs of gig and platform workers and providing them with the support they deserve.

The urgency shown by the Rajasthan government can be attributed to the upcoming Assembly elections in the state. By taking swift action to establish the welfare fund, the government is demonstrating its commitment to addressing the concerns of gig and platform workers, a substantial voting demographic. This move not only highlights the government’s responsiveness to the needs of its citizens but also sets a precedent for other states to follow suit.

However, it is important to note that the implementation of the welfare fund is just one part of the larger picture. Comprehensive regulations and policies need to be formulated and implemented at the national level to ensure that gig and platform workers are adequately protected and receive fair treatment across the country. The success of the Rajasthan initiative should serve as a catalyst for other states and the central government to expedite the process of enacting and enforcing rules that safeguard the rights and well-being of these workers.
