CEO of Greater Noida Industrial Development Authority (GNIDA), Ritu Maheshwari has been sentenced to one month in jail . Also the order for her arrest has been issued. There was a case between a plot allotee and the (GNIDA).
What happened in the case?
A customer named Mahesh Mitra had applied for the allotment of a plot of land in 2001. The GNIDA did not allot the land to Mitra . After which Mitra filed a case in the district consumer forum in 2005 . On December 18 2006, the District Forum stated its judgement on this matter.
The District Forum ordered that the GNIDA should allot a plot of area between 1000 to 2500 square metre to Mahesh according to his need and upon which the terms and conditions will be applied. Moreover, the GNIDA was also ordered to pay the entire legal fee of the matter. After that the GNIDA approached the state commission forum to go against the order pronounced by the District Consumer Forum.
The State Commission stated its judgement on 21 December 2010. It said that the registration amount of Rupees 20,000 will have to be returned . They will also have to pay six percent interest till the date of payment.
Mahesh’s action towards the decision.
Not satisfied with the ruling, Mahesh approached to the National Commission . It gave its decision on 30 may 2014. It said that Mahesh’s position in this matter was correct. The State Commission gave incorrect decision .
Therefore, the decision of district forum was correct. However, the National Commission made minor changes in its decision.
The National Commission said in its decision that any plot of land can be given between 500 to 2500 sq. meter to Mahesh. It will be decided on the basis of project report and its requirement. The GNIDA did not implement this. Mahesh re-approached the National Commission. The GNIDA was again and again countering the decision of the District Forum .
Thus, the president of District Forum, Anil Kumar Pundir and a forum member Dayashankar Pandey have passed a new order stating that GNIDA CEO has been sentenced to one month in jail. She will have to pay a fine of rupees 2000 and a warrant has also been sent to arrest the CEO.
